Privacy Policy

Introduction

Switch Technologies, LLC ("SwitchApp", "we", "us", or "our") operates an AI-powered content creation platform for creators, marketers, and business teams. SwitchApp lets users generate images and videos, organize a library of generated assets, and collaborate with AI agents to plan, prompt, and produce content.

This Privacy Policy describes how we collect, use, share, and protect personal information when you visit or use SwitchApp through the website at switchapp.ai, the mobile web application, our Telegram integrations, and any other digital properties that link to this Privacy Policy (collectively, the "Service").

NOTICE TO EUROPEAN USERS: If you are located in the European Economic Area or United Kingdom, please see the "Notice to European Users" section near the end of this Policy for additional rights and information that apply to you.

1. Personal Information We Collect

1.1 Information you provide to us. You may provide the following kinds of personal information when you create an account, use the Service, contact us, or interact with us:

• Contact data — your name, email address, and (if you choose to share it) your phone number or mailing address. • Profile data — the username, password, and profile picture associated with your account; biographical details; preferences; and any other information you add to your profile. • Authentication data — information received when you sign in using a third-party identity provider such as Google. Our use and disclosure of information received from Google APIs adheres to the Google API Services User Data Policy, including the Limited Use requirements. • Communications data — the contents of messages you exchange with us or with SwitchApp's AI agents (including the in-app operator chat and Telegram CEO chat), feedback you submit, and support requests. • Transactional data — information needed to complete your orders or subscriptions, including order numbers and transaction history. • Payment data — card and billing information required to process payments. Payment data is collected and stored by our payment processor (Stripe), not by SwitchApp directly. See https://stripe.com/privacy for Stripe's privacy practices. • User-shared media — images, videos, reference photos, and any other files you upload, generate, or process through the Service, together with associated metadata (e.g. prompt text, model used, generation parameters, timestamps). • Prompt and command data — the text prompts, commands, questions, instructions, and other content you enter into the Service's prompt bars, chat interfaces, and agent tools. This includes content sent to AI models on our behalf and any system-generated variations of your prompts. • Marketing preferences — your choices for receiving our marketing communications and engagement details (e.g. whether you opened an email). • Other data — additional information you choose to provide, which we will use as described in this Policy or as disclosed at the time of collection.

YOU SHOULD NOT UPLOAD OR PROVIDE US WITH ANY CONFIDENTIAL, SENSITIVE, UNLICENSED PROPRIETARY, OR BIOMETRIC INFORMATION THROUGH THE SERVICE.

1.2 Information from third-party sources. We may combine the information you provide with information we obtain from third parties, including: • Identity providers (such as Google) that you use to sign in. • Payment processors (such as Stripe). • Service providers that help us operate SwitchApp (hosting, analytics, cloud storage, AI model providers, email delivery). • Public sources such as social media profiles and publicly available content.

1.3 Information collected automatically. We and our service providers may automatically log information about your device and how you interact with the Service, including: • Device data — operating system, browser type and version, screen resolution, device type, IP address, unique device identifiers, language, and general location (city/region). • Usage data — pages or screens viewed, features used, time spent in the Service, referring URLs, navigation paths, click and tap events, and error logs. • Communication data — whether you opened our emails and clicked links within them.

1.4 Cookies and similar technologies. We use cookies, local storage (including IndexedDB), and similar technologies to keep you signed in, remember your preferences, operate the Service, and analyze usage. You can control cookies through your browser settings, though some features of the Service may not work correctly if you disable them.

2. How We Use Your Personal Information

We use your personal information for the following purposes, or as otherwise described at the time of collection:

2.1 Service delivery and operations. To provide the Service, create and maintain your account, process your requests, enable security features, route your prompts to the appropriate AI models, store and organize your generated content, and communicate with you about Service announcements, updates, and support.

2.2 AI model execution. When you submit a prompt or use an AI tool, we send the relevant content (text prompts, reference images, generation parameters) to the AI model providers we use on your behalf. These may include, among others, Anthropic, OpenAI, Google (Gemini), FAL, Replicate, and similar third-party AI providers. Each provider's handling of the content is governed by its own privacy and data-use policies. We do not control those policies and encourage you to review them.

2.3 Personalization. We use your usage history, preferences, and past generations to personalize your experience — for example, by remembering your preferred models, resolutions, reference images, and style settings across sessions.

2.4 Service improvement and analytics. We analyze how the Service is used so we can improve features, fix bugs, monitor performance, and develop new products. We may use aggregated or de-identified data for these purposes.

2.5 AI training. We may use your prompts, generated outputs, and user-shared media to improve the Service, including (where permitted by law and our agreements with AI providers) fine-tuning SwitchApp-specific models or evaluating prompt quality. We will not sell your content to third parties for their own AI training without your consent.

2.6 Marketing. With your permission where required, we may send you marketing emails about SwitchApp features, promotions, and updates. You can opt out at any time using the unsubscribe link in each email or by contacting support@switchapp.ai.

2.7 Compliance and protection. We use personal information to comply with applicable laws, respond to legal requests, enforce our Terms of Service, protect the rights and safety of SwitchApp and its users, prevent fraud and abuse, and investigate violations of our policies (including our content policy for generated media).

2.8 Aggregated and anonymized data. We may create aggregated, de-identified, or anonymized data from the personal information we collect and use it for any lawful purpose, including analyzing usage patterns and improving the Service.

3. Data Retention

We retain personal information for as long as necessary to fulfill the purposes described in this Policy, including to deliver the Service, comply with legal obligations, resolve disputes, and enforce our agreements.

When we no longer need personal information, we will delete it, anonymize it, or securely store it until deletion is possible. The exact retention period depends on the type of data, its sensitivity, and any applicable legal or accounting requirements.

When you delete an image or asset from SwitchApp, it is removed from your library immediately and purged from active storage within 30 days. Backup copies may remain in encrypted archives for up to 90 days before final deletion. If you delete your account, we will delete or anonymize your personal information within 90 days of account deletion, except where we are required or permitted by law to retain it longer.

4. How We Share Your Personal Information

We share personal information with the following categories of recipients:

• Service providers and AI model providers. Companies that help us operate the Service, including hosting (Vercel, Supabase), storage (Supabase Storage), analytics, email delivery, customer support, background job processing (Trigger.dev), and AI model execution (Anthropic, OpenAI, Google, FAL, Replicate, and similar providers). • Payment processors. Stripe processes your payment information directly. We do not store full card numbers on our own servers. • Identity providers. If you sign in with Google (or another supported identity provider), we exchange data with that provider as needed to authenticate you and, with your permission, access specific APIs (such as Google Drive if you opt in). • Legal and safety. We may disclose personal information to law enforcement, government authorities, or private parties when we reasonably believe disclosure is necessary to comply with the law, enforce our Terms, or protect the rights, property, or safety of SwitchApp, our users, or others. • Business transfers. If SwitchApp is involved in a merger, acquisition, financing, or sale of assets, your personal information may be transferred as part of that transaction. We will notify you (for example by a prominent notice on the Service) before personal information becomes subject to a different privacy policy. • Professional advisors. Accountants, lawyers, insurers, and auditors who need the information to provide professional services to SwitchApp. • With your consent. We will share personal information with any other party when you ask us to or give us permission to do so.

We do not sell your personal information in the traditional sense, and we do not share it with third parties for their own independent marketing purposes without your consent.

5. Your Choices

5.1 Access and update. You can view and update your profile information from within the Service. To request a copy of other personal information we hold about you, contact us at support@switchapp.ai.

5.2 Delete content. You can delete individual images, videos, folders, or other content from your library at any time using the delete controls in the Service. Deletion is purged from active storage within 30 days.

5.3 Delete your account. To request account deletion, contact us at support@switchapp.ai. We will delete or anonymize your personal information within 90 days, subject to any legal or contractual retention requirements.

5.4 Opt out of marketing. Use the unsubscribe link at the bottom of any marketing email, or contact support@switchapp.ai. Opting out of marketing does not affect service-related communications (e.g. security alerts, billing notices, and changes to this Policy).

5.5 Cookies. Most browsers let you block or delete cookies through your browser settings. Disabling cookies may limit some Service features.

5.6 Do Not Track. SwitchApp does not currently respond to Do Not Track browser signals.

6. Security

We use technical, organizational, and physical safeguards designed to protect your personal information, including encryption in transit, access controls, and secure storage. Payment data is handled by our payment processor (Stripe) and is not stored on our servers.

No security system is perfect. We cannot guarantee the absolute security of your personal information, and you use the Service at your own risk. If you believe your account has been compromised, contact us immediately at support@switchapp.ai.

7. International Data Transfers

SwitchApp is operated from the United States. If you access the Service from outside the United States, your personal information will be transferred to, stored in, and processed in the United States. The data protection laws in the United States may differ from the laws in your country.

We use service providers and AI model providers that may operate in other countries as well. Where we transfer personal information outside the European Economic Area or United Kingdom, we rely on appropriate safeguards such as Standard Contractual Clauses approved by the European Commission, adequacy decisions (including the EU-U.S. Data Privacy Framework where applicable), or other lawful transfer mechanisms.

8. Children

The Service is not directed to anyone under 18 years of age. We do not knowingly collect personal information from children under 18. If you are a parent or guardian and believe we have collected information from your child, please contact us at support@switchapp.ai and we will take steps to delete that information.

9. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. If we make material changes, we will notify you by updating the "Effective" date at the top of this Policy and, where appropriate, providing additional notice (such as an in-app message or email). Your continued use of the Service after the changes take effect indicates your acceptance of the updated Policy.

10. Notice to European Users

If you are located in the European Economic Area or the United Kingdom, this section provides additional information about your rights under the General Data Protection Regulation (GDPR) and the UK GDPR.

Controller. Switch Technologies, LLC is the controller of your personal information for the purposes of the GDPR.

Legal bases. We rely on the following legal bases to process your personal information: (a) performance of a contract with you (to deliver the Service); (b) our legitimate interests (to operate, secure, improve, and promote the Service); (c) your consent, where required by law; and (d) compliance with legal obligations.

Your rights. Subject to applicable law, you have the right to access, correct, delete, restrict, or object to our processing of your personal information; the right to data portability; and the right to withdraw consent where we rely on it. You also have the right to lodge a complaint with your local data protection authority.
